Welcome to CollorTube! These Terms of Use conditions govern your use of our Chrome extension. By installing or using CollorTube, you agree to these terms.

1. Overview

CollorTube is a Chrome extension that highlights YouTube video timestamps based on upload date, making it easier to identify newer and older content. Upon purchase, users receive:

• License Key:
  A license key via email
• Full Access:
  Access to the extension's full functionality
• Device License:
  License for use on the number of devices specified in your purchased plan

2. License Terms

• License Duration:
  Your license is valid for the period specified in your purchased plan (typically 1 or 3 years).
• Device Activation:
  Each license can be activated on the number of devices specified in your purchased plan.
• License Transfer:
  Licenses are non-transferable and tied to the email address used for purchase.
• Updates:
  We reserve the right to update, modify, or discontinue the extension at any time.

3. User Restrictions

You agree not to:

• Reverse Engineering:
  Reverse engineer or attempt to extract the source code of the extension
• Redistribution:
  Redistribute, sell, lease, or transfer the extension to others
• Unauthorized Use:
  Use the extension for any illegal or unauthorized purpose
• Circumvention:
  Attempt to circumvent the license verification system

4. Payment and Refunds

• Secure Payments:
  All payments are processed securely through LemonSqueezy, our payment processor.
• No Refunds:
  All purchases are final, and we do not offer refunds once a license key has been issued.
• Price Changes:
  Prices are subject to change, but changes will not affect already purchased licenses.

5. Privacy and Data

CollorTube collects minimal data necessary for license verification:

• Email Address:
  Email address
• Device ID:
  Device ID for license activation
• No Browsing Data:
  No browsing history or YouTube usage data is collected

6. Disclaimer of Warranties

COLLORTUBE IS PROVIDED 'AS IS' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE EXTENSION, INCLUDING WITHOUT LIMITATION THE RESULTS OBTAINED THROUGH THE EXTENSION. THE EXTENSION IS NOT WARRANTED TO BE ERROR-FREE.

COLLORTUBE IS DEPENDENT ON YOUTUBE'S WEBSITE STRUCTURE AND THE CHROME BROWSER. WE ASSUME NO RESPONSIBILITY IF THE EXTENSION STOPS FUNCTIONING PROPERLY DUE TO CHANGES MADE BY YOUTUBE TO THEIR WEBSITE, OR CHANGES MADE BY GOOGLE TO THE CHROME BROWSER OR CHROME WEB STORE. WE WILL MAKE REASONABLE EFFORTS TO UPDATE THE EXTENSION WHEN SUCH CHANGES OCCUR, BUT DO NOT GUARANTEE CONTINUOUS FUNCTIONALITY.

7. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OF THE EXTENSION, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THESE TERMS AND THE EXTENSION, WHETHER IN CONTRACT OR TORT OR OTHERWISE, WILL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE.

8. Termination

We reserve the right to terminate your license at any time if you violate these Terms. Upon termination, you must cease all use of the extension.

9. Changes to Terms

We may update these Terms from time to time. You will be notified of any material changes via email or through the extension.

10. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.

11. Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, interpretation, breach, or termination thereof, shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Florida, USA or in a location of choice decided by the creator of CollorTube, by a single arbitrator, and shall be conducted in English. The decision of the arbitrator shall be final and binding on the parties, and judgment on the award may be entered in any court of competent jurisdiction. You agree that arbitration shall be conducted on an individual basis, and that neither you nor we may bring or participate in any class or collective action.

12. Class Action Waiver

YOU AND COLLORTUBE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and CollorTube agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

13. Force Majeure

CollorTube shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond our reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation, acts of God, pandemic, epidemic, civil or military authority, acts of terrorism, riots, natural disasters, strikes, labor disputes, or supply chain disruptions. If a force majeure event occurs, our obligations under these Terms shall be suspended for the duration of the force majeure event.
